TERMS OF SERVICE
The terms that apply when you engage Brambla for design, build, marketing or maintenance work. Plain English — no lawyer wallpaper.

These terms govern the engagement between you (“the Client”) and SDB Digital Ltd, trading as Brambla (“we”, “us”, “Brambla”). They apply to all paid services we provide unless a separate written agreement says otherwise. The LIVE30 free-website offer has its own dedicated terms.
1. Services we provide
- 7 Day Website — fixed-scope one-off website builds (Simple, Standard, Complex tiers). Delivered on Brambla-managed hosting.
- Custom Website — bespoke design and development for larger or more complex projects. Codebase ownership and host-portability are agreed in the quote.
- Branding — logo design, brand identity systems, and brand collateral (Starter, Professional, Full tiers).
- SiteCare — ongoing managed hosting, security, backups and content support (Essential, Growth, Premium tiers, billed monthly on rolling 30-day terms).
- SEO Care — ongoing SEO management, content updates and local visibility work (Essential, Growth, Elite tiers, billed monthly on rolling 30-day terms).
- Website Audit — one-off technical and content audit (Free Mini, £149 Full tiers).
- AI Visibility & GEO — work to improve how your business appears in AI-powered search (ChatGPT, Perplexity, Google AI Overviews).
The specifics of your engagement — scope, deliverables, timeline, milestones, payment schedule — are set out in a written quote, proposal, or order confirmation (“Quote”) that we send you before work begins. Where these terms and the Quote say different things, the Quote wins for that engagement.
2. How an engagement starts
- You contact us (via the website form, email, phone or WhatsApp) with a brief or enquiry.
- We respond, ask clarifying questions, and either send a Quote or recommend a different product.
- You accept the Quote in writing (email reply counts) — and that's the moment the engagement is binding on both sides.
- For subscription services (SiteCare, SEO Care), accepting the Quote and setting up your Stripe subscription starts your service. The first billing cycle begins on the date agreed in the Quote (typically the day the service goes live, sometimes after a free intro period).
3. Payment
One-off projects (7 Day Website, Custom Website, Branding, Website Audit)
- Payment terms are set in the Quote — typically a deposit on acceptance + balance on delivery, or split into milestones for larger projects.
- Payment plans (3-month, 6-month) may be available for projects above a certain value, with a small markup over the upfront price. Plans are agreed in the Quote and billed monthly via Stripe.
- Invoices are payable within 14 days unless the Quote says otherwise. Late payment may attract interest at the rate set in the Late Payment of Commercial Debts (Interest) Act 1998 (8% above Bank of England base rate, where applicable).
- For projects where Brambla retains hosting (e.g. 7 Day Website on SiteCare): if hosting is cancelled or unpaid, the site may be taken offline per the cancellation terms in section 6.
Subscription services (SiteCare, SEO Care)
- Rolling 30-day billing, charged in advance via Stripe.
- No minimum term for the standard SiteCare and SEO Care tiers — cancel any time and your service stops at the end of the current billed period.
- Where a Quote specifies a different commitment period (for example, a discounted 6-month or 12-month plan), the minimum term applies as agreed in writing.
- VAT: prices are inclusive of any applicable UK VAT.
- Failed payments: we'll retry the card automatically. After 7 days of failed payments without resolution, the service may be paused. We'll email before this happens.
4. What we'll do
- Deliver the work to the standard described in the Quote, within the agreed timeline.
- Tell you straight away if a deadline is at risk, and propose a revised plan.
- Handle your data and content securely (see our Privacy Policy).
- Keep you in the loop on progress through clear communication — typically email and WhatsApp, or whichever channel you prefer.
- Use AI tools (including Anthropic's Claude) to accelerate code generation, content research and design iteration in our internal workflow — never for automated decisions about your engagement. See How we build.
5. What we'll need from you
- Content and approvals on time. Most project delays come from waiting for text, photos or sign-offs. We'll set realistic dates in the Quote — if these slip, the overall timeline slips with them.
- Rights to the content you provide. You confirm you own (or have permission to use) all text, photos, logos and assets you give us.
- Access where needed. Domain DNS, existing site logins, social account managers, etc., depending on the scope.
- Payments by the dates in the Quote.
6. Cancellation
One-off projects, before launch
You can cancel a one-off project before launch at any time. We'll invoice for work completed up to that point against any deposit already paid. If the deposit covers the work done, no further payment is needed; if work exceeds the deposit, the balance is payable within 14 days.
One-off projects, after launch
Once a project is delivered and approved, the engagement is complete. If you've also signed up for SiteCare or SEO Care, those are separate rolling subscriptions and can be cancelled at any time per below.
Subscription services (SiteCare, SEO Care)
- Cancel anytime via the Stripe customer portal link in your billing emails, by replying to any of our emails, by WhatsApp, or by emailing hello@brambla.co.uk.
- Your service continues until the end of the current billed period — we don't mid-month cancel.
- No refunds on partial months — you keep the days you've paid for.
- For SiteCare on a 7 Day Website build: if SiteCare is cancelled and the site is hosted by Brambla, the site goes offline at the end of the billed period unless we've agreed a hosting transfer in advance.
7. Intellectual property
- Your content stays yours. Any text, photos, logos and other materials you supply remain your property.
- Brand assets we design for you (Branding service): on full payment, we assign full ownership of the final logo and brand identity files to you, royalty-free, in perpetuity.
- Custom Website builds: on full payment, we assign ownership of the codebase we've written specifically for your project. The Quote will spell out what's assigned, what stays with Brambla (e.g. shared component libraries or internal tooling), and any third-party licences.
- 7 Day Website builds: the site is delivered as a hosted service on Brambla infrastructure. The site, its code and its design stay on our infrastructure for the duration of the SiteCare subscription. If you need a transferable codebase, the Custom Website service is the right product.
- “Built by Brambla” credit. A discreet credit in the site footer is included by default. On Custom Website builds this can be removed on request. On 7 Day Website builds this is not removable.
- Portfolio rights. We may include a finished project in our portfolio (screenshots, brief case study description) unless you ask us not to. We'll never share commercially sensitive details without permission.
8. Data processing
For services where we process personal data on your behalf (typically: hosting a site that has its own contact forms, or running a marketing campaign with your customer list), we act as a data processor under UK GDPR Article 28. The terms of that processing are set out in our Data Processing Agreement, which forms part of these Terms.
Where we collect data from visitors to brambla.co.uk directly (e.g. enquiry forms), we act as a data controller under our Privacy Policy.
9. Acceptable use of hosted services
If we host your site (under SiteCare, LIVE30 or as part of a 7 Day Website build), you agree to our Acceptable Use Policy. We reserve the right to take action (including, in serious cases, suspending hosting) for content that breaches it — typically illegal content, malware distribution, or activity that harms other users or our infrastructure.
10. Confidentiality
Both parties agree to keep confidential any information shared in the course of the engagement that is reasonably understood to be sensitive (e.g. unreleased product details, pricing strategies, customer data). This applies during the engagement and for 2 years afterwards. It doesn't apply to information that is or becomes public through no fault of the receiving party.
11. Warranties and liability
- We deliver work to a professional standard using reasonable care and skill.
- We don't guarantee any specific business outcome — including search rankings, conversion rates, traffic volumes or revenue.
- Hosting is provided on a best-effort basis. We aim for high uptime but can't guarantee 100% availability.
- We're not liable for indirect, consequential or special losses (lost profits, lost data, lost leads, business interruption) arising from our services.
- Our maximum aggregate liability for any claim is limited to the total fees you've paid us in the 12 months preceding the event giving rise to the claim. For ongoing subscription services that limit is the previous 12 months of subscription fees; for one-off projects it's the project fee.
- Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that can't be limited by law.
12. Termination by us
We may terminate or suspend services if:
- Payment is more than 30 days overdue and reasonable attempts to resolve have failed.
- You materially breach these terms (e.g. the Acceptable Use Policy) and don't fix the breach within 14 days of being asked.
- We're required to by law or by an order from a regulator or court.
We'll give reasonable notice except where the breach is serious enough to justify immediate suspension (illegal content, security risk to other users).
13. Changes to these terms
We may update these terms from time to time. For material changes (e.g. a price increase, a new limitation on services), we'll give at least 30 days notice by email. You're free to cancel before the change takes effect. Non-material changes (typos, clarifications) take effect on publication.
14. Governing law
These terms are governed by the laws of England and Wales. Any dispute that can't be resolved amicably is subject to the exclusive jurisdiction of the English courts. We always prefer a phone call or coffee to a courtroom — please contact us first if something isn't right.
